Do I need a permit for my fence?

Permit requirements for installing or replacing a fence in unincorporated Pinellas County depend on three key factors: whether the property is in a flood zone, the fence height and its construction materials.

Fences in Designated Flood Zones

If your property is in a Special Flood Hazard Area (Flood Zone), you must obtain a Floodplain Permit before installing or replacing a fence. Under Pinellas County Land Development Code (Sections 158.3 and 138.3702), floodplain reviews ensure fence installations do not endanger surrounding properties.

Fences Outside Flood Zones

Standard wood, vinyl or chain-link fences up to 6 feet tall on properties outside of designated flood zones generally do not require a zoning clearance, building permit or floodplain permit. However, a Zoning Clearance is required if:

  • The fence is within your front setback.
  • The property is a corner lot.

Work That Always Requires a Building Permit

Regardless of whether the property is within or outside a floodplain, a permit is required for:

  • Fences over 6 feet tall
  • Metal, solid or mortared masonry, columns, brick/concrete walls or wall sections
  • Seawalls of any height
  • Retaining walls more than 2 feet high from top of grade to top of retained fill
